Oidà is a website that offers a free service to the user. This service is explained and defined in the “Service Description” section (hereinafter the Service) of these terms of use and in no case includes a sale of products by Oidà.

In general, access to the content and use of the website's Service is free and no prior user registration is necessary.

However, to use part of the Service offered by the website, it will be necessary to enter personal data via a form and a registration process may also be required, for which the corresponding registration forms will be provided requesting the entry of personal data.

Seller: is the owner of the product, either as the producer or as the owner of the establishment selling the product. The Seller is the one who carries out the sale of the product to the user.

User: is the person browsing the Oidà website and using its Service.

Whatssap: is the instant messaging application provided by WhatsApp Inc under its terms and conditions.

Product: refers to the products for which the website provides information or a brief description and which can subsequently be added to a shopping list.

4. Description of the Service subject to these conditions.

Oidà offers a free service consisting of the following:

• i) Provides information or a brief description of different consumer products.
• ii) Provides a tool so that the user can choose and add a Product to a shopping list.
• iii) Creation of a shopping list with the products chosen by the user.
• iv) Creation of an information file with the shopping list and contact details provided by the user, which Oidà will transmit to the user's Whatssap instant messaging system, so that the user can then send the shopping list to the Seller via said messaging system.

Therefore, the service offered by Oidà DOES NOT INCLUDE any product sale transaction, nor any data transmission to the Seller, but only provides a direct contact service with the Seller, so that the user can contact the product Seller using the Whatssap communication system with an already created order or shopping list. Once the user and the Seller are in contact, both can reach an agreement to carry out the purchase and sale of the products.

Accordingly, Oidà assumes no responsibility for the purchase of the product, as explained in the section “Exclusion of liability regarding the product and the sale carried out by the Seller”.

Throughout these conditions, when the Service is mentioned, it refers to the description provided in this section.

5. Legal age.

You do not need to be of legal age to browse our website.

You must be of legal age to use the Service.

6. How the Service works

Requirements: Users who wish to use the service must have a WhatsApp account and have the WhatsApp application installed on the device they are using to browse the website, or access WhatsApp web.

How it works: The user must choose the products they wish to purchase. Once chosen, they must add them to the shopping list. Once added to the shopping list, the user can send said list to each Seller of the different products they have chosen. To send the shopping list to each Seller, it is necessary to add the contact details requested in the form provided by the website. The shopping list, together with the contact details provided, forms the order and is an information file that Oidà will send to the user's own WhatsApp, which will open a chat with the Seller where the order will appear, ready to be sent directly to the Seller. Once the direct chat with the Seller has been created, the user must send the order. To do this, they must click their WhatsApp send icon.

Oidà does not send any personal data to the Seller.

Once the user has sent the order to the Seller, both will be in direct contact with each other to carry out the sale. The conditions of sale will be agreed upon by the User and the Seller, with Oidà excluded from liability and disconnected from any agreements that the user and Seller may have reached.

7. Disclaimer regarding the product and the sale carried out by the Seller.

Product description disclaimer: Oidà informs the user that product descriptions and information have been provided by the Seller. Oidà assumes no responsibility for the truthfulness or inaccuracy of the product information provided on the website, and any error, inaccuracy and/or omission regarding product information is the responsibility of the Seller.

Disclaimer on buying, selling and conditions of sale: Oidà does not carry out any sales. As explained in the “How the service works” section, Oidà only provides a service to put the user in contact with the Seller; therefore, the conditions of sale between the Seller and the user, regarding, among others, price, payment method, delivery method and terms, after-sales service, return and withdrawal policies if applicable, will be, where appropriate, agreed between the Seller and the User. Consequently, Oidà is a third party not linked to the final buying and selling operation carried out between the User and the Seller, which is why Oidà is exempt from any responsibility regarding the sale carried out, given that Oidà does not intervene nor is it a party to it.

Disclaimer on product quality and condition: In accordance with the above, Oidà is not the seller nor part of the Sale between the Seller and the user, therefore Oidà assumes no responsibility for the quality or the good condition of the product.

Disclaimer regarding the Seller: Oidà does not guarantee at any time that the Seller will attend to or respond to the request made by the User, nor does it guarantee that the sale of the product can be carried out, as the sale of the product is outside its control and jurisdiction, since, as previously stated, the sale is carried out by the Seller.

8. Exclusion of warranties for the operation of the website and the Service:

The User shall use the website or the information provided therein on their own account and at their own risk. Oidà is not responsible for any damages or losses of any kind that may occur due to a lack of accuracy, completeness, timeliness, as well as errors or omissions that may exist in the information, content and services of this website. The information provided by Oidà is for informational purposes only.

Disclaimer of warranty for the operation of the website and the Service: Likewise, Oidà does not guarantee the availability, continuity or infallibility of the operation of the website and the Service, and consequently excludes, to the maximum extent permitted by current legislation, any liability for damages and losses of any nature due to the lack of availability or continuity of the operation of the website and the Service, as well as access errors to the various pages that can be accessed through the website.
